Rebel landlord Tony Blows is the first person to be prosecuted in the county over the country's anti-smoking laws.
Tony, who runs The Dog at Ewyas Harold, will plead not guilty.
The case has been brought by Herefordshire Council after undercover visits by officers to the pub.
He faces charges of twice failing to stop customers smoking and of smoking there himself.

What you have to ask is, can the Herefordshire tax payer afford to fund this stupid law all the way to The Europeen Court of Human Rights. because thats where it will end up. smoking a legal substance on private property CANNOT be against the law.
The council have bitten off more than they can chew with this one. This ill conceived law, an affront to civil liberties and property rights based on lies and propaganda, will be torn to shreds before a dispassionate judge.
Well done Tony for standing up where so many have rolled over.
